WARRANTY AND PRODUCT RETURN

EXPIRY DATE

All products have an expiry date shown on the packaging in accordance with the regulations and producer’s set conditions, as well as the standards used in the production. The expiry date may differ for various product groups. For some products (e.g. cosmetics) the expiry date may be absent on the packaging. It refers to those products that have a definite time of use from the moment of opening, which is mentioned in the added instructions for use. The product may only be used until the date of expiry. The date of expiry is the date of warranty end. In cases of uncertainty, the information on the producer’s set warranty time for the chosen product can be specified by a company employee.


WARRANTY AND PRODUCT RETURN

If during the time of warranty, the product shown quality problems, the client should address the company representatives to agree on further actions. If quality problems have appeared because of the producer or seller, the product with low quality may be exchanged for the same high quality product or an equivalent product, or the money paid for the product is returned to the client. The client is obliged to show documents that prove the purchase: the cash register receipt, consignment note, bank transfer payment receipt, or warranty voucher if such has been received at product purchase. The producer’s warranty conditions are not in force if: -after product purchase, the client has transported or stored it violating the storage and transportation rules; -the client has intentionally or unknowingly damaged the product; has attempted to fix the damage on their own; has performed product repair violating the warranty conditions; -the damage has resulted from the supply voltage, telecommunications or cable wires non-compliance with the producer’s established standards, due to rapid temperature changes, as well as other domestic and outer factors (soot, fume, dust, moisture); -the client does not present the purchase proving documents: the cash register receipt, consignment note, bank transfer payment receipt, or warranty voucher.


RIGHT OF WITHDRAWAL RULES

The right of withdrawal applies only to the purchaser – a natural person. The right of withdrawal is used in accordance with Consumer protection law and the Republic of Latvia Regulations of the Cabinet of Ministers Nr. 255 “Regulations on the distance contract” from 13 June, 2014.

The client can use the right of withdrawal and unilaterally withdraw from the distance contract in 14 calendar days’ time from the day of product receipt, without mentioning the reason. The right of withdrawal for 14 days applies to products purchased in the internet store only. The product must be returned in its original packaging and complete set, together with a filled in refusal blank and purchase proving document, as well as the warranty voucher if such has been received at product purchase. The product may no longer be returned according to these conditions if the client has started using it, because in that way the purchaser confirms the product’s conformity to the order. Please, note that these conditions do not apply to items of personal hygiene and sterile/non-sterile products the packaging of which has been opened and/or damaged. Those products are not accepted back.


RETURNS OF PRODUCTS

In 14 days from the day of product receipt together with a filled in refusal notification-blank, the product can be returned to the office of Ltd. “ERKO group”, Pulkveža Brieža iela 15 (2nd floor), Rīgā, LV-1010. If it is impossible to return the product to the office of Ltd. “ERKO group”, then:
1. In 14 days from the day of product receipt, please, send a refusal notification to Ltd. “ERKO group” e-mail adress: info@kosmed.lv or by mail to Ltd. “ERKO group” postal address: Pulkveža Brieža iela 15 (2nd floor), Rīga, LV-1010;
2. In 14 days from the day of sending the refusal notification, the product together with the filled in refusal notification-blank must be sent by post to Ltd. “ERKO group”, Pulkveža Brieža iela 15 (2nd floor), Rīgā, LV-1010 (paid by client), or the product must be delivered by courier to Ltd. “ERKO group” office. If sent by post or delivered by a courier, the client is responsible for proper, transportation safe product packaging. Only the client or an authorised person has the right to submit the refusal notification. If the refusal notification is submitted by an authorised person, the refusal blank is submitted together with an authorisation.

ACTIONS OF LTD. ERKO GROUP AT RETURNED PRODUCT RECEIPT

At the moment of returned product receipt, Ltd. “ERKO group” has the right to check for possible visual damage of the product and conformity to the contents of the product set. In case if product damage or non-compliance with the product’s visual appearance or set is present at the moment of receipt, the client will be notified and will receive a copy/notification of a statement of findings. In case of a refusal, in 14 (fourteen) days’ time from the day of refusal receipt, the clients will be paid back all payments received from them, including delivery expenses paid by the client at product receipt. The return of 100% amount of the money will be performed via the same payment mode used by the client when purchasing the product. Based on a mutual agreement, a different mode of money return is possible. If in 14 (fourteen) days’ time from the day of refusal receipt the product is still not returned to the seller Ltd. “ERKO group” or if notification is not received confirming the product has been sent out, Ltd. “ERKO group” has the right until product receipt to withhold the money refund.
